Wills
What is a Will?
A Will or a Testament is a legal declaration by which the Testator, names one or more persons to manage his/her estate and provides instructions for the transfer of his property and assets at death.

  • The Testator/Testatrix: person who specifies that the Will be created, but it may be set up in abeyance during the person’s lifetime.

  • The Trustee: whose duty is to carry out the terms of the Will. He or she may be named in the Will, or may be appointed by the Probate Court handling the Will.

  • The Beneficiary(s): who will receive the benefits under the terms of the Will;

  • The Executor/Co Executors : Persons appointed by the Testator/Testatrix to carry out the wishes expressed in his or her will.

  • (RSA)- Retirement Saving Account: is a dedicated account opened with a Pension Fund Administrator as specified under Section 11 of the Pension Reform Act of 2014.
When should I write a Will?
You should write a Will right now because no one knows what tomorrow holds. A person should review his estate plan occasionally, especially after certain events, such as marriage, divorce, life changing illness and winning the lottery.
What are the requirements for a Will?
The Will must be in writing, signed by the person whose Will it is (the “Testator“) and witnessed by two persons.
The testator normally must have attained the age of majority, and must be of “sound mind” at the time the Will is executed.
The witnesses normally MUST be “uninterested persons,” meaning they’re not beneficiaries of the Will. Witnesses also must be competent persons.
A Will should be stamped and lodged in the Probate Court.
Who needs a Will?
Almost everyone needs a Will. If you have anything of value and want it in the hands of your loved ones, you should definitely consider writing a Will.
Who should draft my Will?
United Capital Trustees can assist in drafting, stamping and lodging your Will with the appropriate authorities. We will provide you a copy and retain a copy in our custody.
Can a Will be changed?
A new Will or a “codicil” can be executed to replace the old one. It is usually advisable to change your Will on the birth, death, divorce or an occurrence of a major event in your life
Can I appoint United Capital Trustees as Trustees to my Estate?
Yes, Our expertise is not just limited to drafting of Wills but also executing the will and acting as Trustees.
May I appoint a guardian for my children in my Will?
Yes. This is another valuable benefit that a Will can provide for minors, children below 18 years old and/or children in full time education until the age of 21 years. A Guardian can work together with the Trustees to fulfill the overall intention of the Will.
Can a Will be contested?
A person contests a Will by completing the relevant documents with the Probate Court. The person contesting the Will is usually an “interested” person, that is, he/she must be an heir under the Will or at law. There are time limits for contesting a Will.
You must have grounds to have a chance of successfully contesting a Will. Unhappiness with the proposed distribution of property is not a valid ground. Valid grounds such as Incapacity, fraud, undue influence and duress are the most common grounds.
If I die, what is the process involved in my Beneficiaries getting the assets?
Once the Testator is dead and buried; the family together with United Capital Trustees (if appointed Executors to the Estate) will provide notice of probate to all interested parties and Beneficiaries. The “reading the Will” shall be scheduled, and the interested parties can obtain a copy of the Will from the Probate Court. After this, we will oversee the distribution according to the Testator’s wishes.
What are the Trustees/Executor’s duties and obligations?
Duties will include:
  • Giving the proper notices to the proper parties
  • Collecting all the deceased’s property
  • Receiving claims against the Estate
  • Paying just claims and disputing others
  • Distributing the estate property according to the Will
  • Along the way there may be other necessary actions, like selling estate property to cover debts or allow for proper distribution.
What happens if you die without a will?
Your family members will have to apply for Letters of Administration.
Can I subscribe to the Simple Will ?
Yes, you will be able to subscribe in your individual capacity through the simple Will via the InvestNow Platform
Why must an estate go through Probate Court?
So that the Testator’s affairs can be legally concluded. If there are assets, legal authority is required by the Executors and Trustees to transfer the property to the beneficiaries.
